Will you get banned for using a flashed or modded xbox 360 to play original games online.?

If you have a flashed or modded xbox 360 and play the downloaded games offline and originals online, will u still get banned on live.

    It's not the games that get scanned, it's the system. So you can even go online without any game in the system and still get banned.

    I replaced my dvd drive and had to flash the new one so it would work in my xbox. Of course the only firmware i could find was modded. I play store purchased games on xbox live for 8 months now without being banned.
